Employees Who Make Wage Claims to Employers Are Protected From Retaliation

Schuck Law won a key Ninth Circuit ruling confirming that employees are protected from retaliation when they complain about unpaid wages directly to their employer – not just through formal legal channels. The Court held that speaking up to a manager is a protected act under the law.

Schuck Law’s attorneys prevailed at the Court of Appeals for the Ninth Circuit in arguing that employees are protected from retaliation when making complaints of unpaid wages to their employers, not just when filing a wage complaint with a court or a state agency.  The Ninth Circuit held that an employee complaining of unpaid wages to a manager or “boss” is a protected action and employers can’t legally retaliate.
