Oregon Vacation Pay Law.
Under Oregon wage and hour law, where an employer has agreed to pay vacation pay and the vacation pay is not paid, the employee has a vacation pay wage claim. Depending upon the facts of the specific vacation pay wage claim case, the employer could be liable for the unpaid vacation pay. In addition, the employee may be due penalty wages for the employer’s failure to pay all vacation pay wages at termination. Penalty wages are calculated my multiplying the regular hourly rate by 8 hours per day for a maximum of 30 days. Under Oregon wage and hour law, where an employer has agreed to pay paid time off (PTO), and refuses to pay the paid time off (PTO),the employee has a paid time off (PTO) wage claim. Depending upon the facts of the specific paid time off (PTO) wage claim case, the employer could be liable for the unpaid paid time off (PTO) wages.
In addition to the unpaid vacation or PTO wages, if your employment has ended, you may be entitled to penalty wages for your Oregon employer’s failure to pay all wages when due at termination (quit or fired). Late Pay Page. The penalty wages are calculated through the following formula: (hourly rate * 8 hours per day * 30 days maximum). At the hourly rate of $15.00, the maximum amount of penalty wages for the failure to pay vacation or PTO wages would be $3,600.
